Job Description

The Kansas Department of Labor, Division of Workers Compensation, is actively recruiting an attorney to serve as a key legal advisor overseeing workers compensation matters. This role offers substantive legal work, direct interaction with senior leadership, and meaningful engagement with both internal and external stakeholders. Responsibilities include conducting mediations, presiding over formal medical dispute hearings, issuing decisions and mediations as necessary.

Key Responsibilities:

  • Advise the research unit on complex and unusual public records requests.
  • Respond to subpoenas, Kansas Open Records Act (KORA) requests, and requests for records to be certified to the Court of Appeals, ensuring timely and accurate delivery of certified documents.
  • Serve as legal advisor to the Acting Director and provide guidance to division units on legal and regulatory matters.
  • Assist with interpretation and implementation of workers compensation laws, rules, and regulations.
  • Act as liaison between the Division and external constituents, including attorneys and their staff, insurance carriers, medical providers, claimants, and other governmental agencies.
  • Assist with development, maintenance, and application of the Medical Fee Schedule.
  • Draft, revise, and update workers compensation regulations, including filing with the Department of Administration, Attorney General’s Office, and Secretary of State.
  • Coordinate and participate in public hearings and provide testimony before legislative committees.
  • Revise and maintain the Division’s records retention schedule, including filings and appearances before the State Records Board.
  • Review Final Receipts and Releases of Liability for compliance and ensure timely rejection of noncompliant submissions.
  • Review appellate court decisions, enter decisions into the Division’s database, and distribute copies to the Board, Administrative Law Judges, and Ombudsman Unit.
