Position Summary: The Assistant County Counselor assists the Riley County Counselor to provide legal counsel to the Board of Commissioners and County Department Heads. The position is a resource to the County for matters involving contractual agreements, Benefit Districts, the annual filing of a tax foreclosure case, human resources matters and may be asked to provide advice and direction to the Board of Commissioners on all areas of county government as needed.
Essential Functions:
- Represent the Board of County Commissioners under the purview of the County Counselor.
- Advise on legal questions and assist the County Counselor on legal matters. In the absence of the County Counselor, advise department heads and department supervisors with legal questions.
- Commence, prosecute, or defend, as the case requires, assigned civil suits or actions in which County is interested and represent County generally in all matters of civil law.
- Draw contracts and other papers or documents required by the County, as directed, and furnish opinions in writing upon legal matters pending before the County, when requested.
- Assist the County Counselor in the duties provided by K.S.A. 19-716 and amendments thereto.
- Collect delinquent personal property taxes, in collaboration with appropriate County Departments.
- Assist the Human Resources Director and Department Heads in personnel matters, as required.
- Supervise the preparation and filing of bankruptcy court, mortgage foreclosure and probate claims for real and personal property tax debts owed Riley County.
- Serve as primary point of contact for formation and expansion of Riley County sewer, water, and paving districts, with the County Clerk, Public Works department, citizen petitioners, and others.
- Collaborate with the Planning & Development department to enforce zoning and sanitary codes.
- Conduct a real property tax foreclosure case annually.
Secondary Functions:
- Attend Board meetings and present proposed policies, programs and plans aimed at addressing overall county needs for review, revisions and approval by the Board of Commissioners as needed.
- Perform other duties as assigned.
